OK, so I've just moved out from both the nicest place I've ever had the privilege of living, but with the most horrible landlady, Tatyana Day, I've ever had the misfortune of renting from. I will be taking her to Court, and this blog will serve as a public repository and running commentary on my case against her.
In this first post, I will start by posting one of the provisions from the lease, which I will upload in its entirety as soon as I can figure out how to do that with a PDF file, for reasons that will become obvious after the provision is read. So, here it is, provision 26 from the lease:
26. RECORDING OF AGREEMENT. Tenant shall not record this Agreement on the Public Records of any public office. In the event that Tenant shall record this Agreement, this Agreement shall, at the Landlord’s option, terminate immediately and Landlord shall be entitled to all rights and remedies that it has at law or in equity.
So, just what must a lease contain that would warrant such a stipulation, you might wonder? Well, stay tuned and you will see...

Kay st. - we took that evil creature to court and won. However, the hard part is actually collecting. I'm trying to find out where she works, so we can garnish her wages. Although I doubt she has a job other than stealing security deposits and bending over :)

Jack, you don't have to garnish her wages if she has none, you can seize her property (furniture etc up to the value of what she owes you). I think you need a court order or a police man to accompany you but that is easy to get that since it's all done legally.

Her "Exclusive Properties" is registered right under the premise - 1209 N. Taft St.

Apparently I am the latest victim of her scam. I lived there for about 5 months at the beginning of this year (2013) from January to May. She claimed I would get my deposit back the first few times I contacted her, then stopped responding altogether. Unbelievable. Any advice from those who took her to court?

ReplyDeleteOur Experience: We found 1209 A North Taft Street listed for rent on Craiglsist for $4500 / month. We emailed the lister, who said we could come by Sunday to look at it. The lister, who did not provide a name, sent an email from "exclusivepropertiesdc@gmail.com". The email said to print the application, bring it, and if interested in renting the unit, give the application and security deposit ($4500) to the tenant (a bit weird, but okay).
On Sunday, we looked at the property. The tenant introduced herself as "Maria" (5'5, 130 lbs, long brown hair, attractive). She showed us the unit. Great layout, but the upstairs was a disaster. Cloths and makeup everywhere. A book, "How to Date like a Man" on the floor. Cigarettes. A laptop on the bed. My wife asked if she was in the fashion industry because of the cloths explosion, she said "sort of". When asked where she was from, she said here relatives are from "Spain". When asked when she was leaving, she said that she was leaving in a few weeks, and was going to pay someone to help her pack, since she obviously hadn't packed a thing. Cloths were strewn everywhere, and you had to watch where you stepped. She was wearing sweat pants and a shirt as if she had just gotten up (it was 11). When asked, she said that the landlord was fine, and she never had any problems with them. They fixed anything needed. She said she didn't work with anyone in particular, but, when pressed, said she had talked to someone named "Tyler" at Exclusive. Lastly, she noted that she was responsible for finding the tenant, as a tenant, because she was breaking her lease to move to "Europe" as soon as possible.

ReplyDeleteWe said we were interested in renting the unit (the layout is great). She suggested that we leave the security deposit now, cause the way the company works, they run the credit check, and rent it to the first person who leaves the deposit. She also had a few other people coming by later to see it.
My wife completed the application form and left a security deposit for $4500 to Exclusive Properties. When we left the place, I said, "That women is a disaster. If her life is anything like her house, she's a mess". I called the number we had for the unit to speak with EP: 202-957-8289. Got a message machine. Left a message.
Her vague answers were also a bit off at the time, but not enough to alert us completely. We applied because we recently missed renting another unit by a day, and didn't want to miss again.
When my wife got home, she did some more research, and found this blog after searching "Exclusive Properties". (Thank You!!!). She called me. I was at the park with our boys. We immediately canceled the checks ($30 app fee and $4500 deposit). I then went back to her house to get them back.
This was 2 hours after we saw it. She answered, wearing the same sweat pants. I told her we were no longer interested, because we got another place we had applied for, and asked for the application and check back. She stammered. This was alerting. She appeared to be looking for a reason not to return our check, but she obviously hadn't left the house. She finally said that she had already called the renting company and they were going to come by and pick up the check and application form later. I said fine, but I'm not renting the place, and asked for the app and check back. She stammered further. I was concerned she wouldn't give them to me, so I said, "just give me the check that would be great." She started to come up with something else, and I interrupted her by saying "Thanks." She finally conceded and returned with the check (but not app forms).
I left. I spoke to my wife, who was reading this blog, and she gave me more details. I then became concerned about her stealing my identity, since I remembered that my wife had asked for my driver's license number for the app form.
Thus, I returned to the house. This was 10 minutes later. I knocked on the door several times, but she didn't answer. Fishy.
I then went to the police station at courthouse to file a possible fraud activities report, and to show my boys how this all worked. The women was very friendly and suggested that I call a non-emergency number. I did, and the police sent a squad car to the house to meet me.
While waiting for the police, "Exclusive Properties" emailed my wife, "Yes it will [be cleaned]. She scanned and sent the applications. They were approved. We will be picking up the deposit check and send you the lease. Thanks. Exclusive Properties Management".
This was a bit off, as she initially told me that she had already called EP, who was coming to pick up the app and check. Then, a few minutes after she didn't answer the door the second time when I went back for the app, we get an email from EP (on a Sunday after they didn't answer our call), saying that the tenant had scanned the forms and we were approved. So was EP picking up the forms, or receiving via scan? And the tenant, whose house and life appeared a disaster, is with it enough to immediately scan and email the forms to help her landlord out?

ReplyDeleteI met the squad car about 20 yards down the street. I explained to the officer that this was hardly an emergency, I just wanted my app form back, and document this possible scam. As I'm talking to him, a group of 4 guys arrived to look at the place. She answers the door and lets them in (she couldn't see me and the police just down the street). So she wasn't home 15 minutes earlier when I knocked (to get the app form back), but was then. She was in the same swear pants and barefoot, suggesting she hadn't gone anywhere. The policeman saw this. He was great. Very professional.
We then went to the door and the policeman knocked. She answered. He asked for the app form back. She said she had already scanned it. The policeman said so, produce it, he's not renting it. She asked if he could come back later, since she was showing the house. The policeman was like, uh, no, the police are not going to come back later. "We're going to resolve this now". Meanwhile, she has the door cracked to keep the prospective tenants from seeing me and police out front. Great stuff. She closes the door, goes inside, and returns with the app form.
The policeman asks for her ID and talks to her. One of the potential renters comes out to say, "we're thinking of renting this place, is there something we should know?" I explain above. He is pleased to have heard this and returns inside to continue seeing the place. I'd loved to hear what she told him after the police left.
The police and I leave. My 6 year old noted that she was wiggling her toes when the policeman was talking to her. I'm now filling out a police report to try to have this documented to protect others. And am going to see what I can do to protect my identity.
In short, my guess is that "Maria", "Exclusive Properties", this address and Tatyana Day are all the same person.
Again, thanks everyone for documenting. Anyone else know if Maria and Tatyana are the same person?
Your description of "Maria" is actually what "Tatyana" or "Tania" looked like when I lived there during the first 6 months of this year. Same disaster of clothes upstairs, always wearing sweatpants etc... She's definitely scamming as many people as possible. The fact that Exclusive Properties is even emailing you and talking to you right now and ignoring all of my calls and emails is pathetic. Wish I could catch her at home and get my money back.

ReplyDeleteI was lucky to realize last minute that she runs a scam, but all you victims should get together and file criminal charges against her.
ReplyDeleteSomeone had similar issue in NY. He stopped paying rent the last few months rent (whatever time is equivalent to the security deposit) and moved out only when he has stayed without paying rent the full time to recover his security deposit. As a landlord she cannot evict you without a court order and it will take her several months to get it. And if she is evil enough to still sue you, she won't get anything since you didn't stay over your security deposit amount
ReplyDeleteAlso had an AWFUL experience from living at her 813 Maryland Ave NE property in DC. Even the neighbors started telling us horror stories about her and warned us not to pay our last month rent as she constantly be sued for unreturned security deposit. Any maitenance issue she blames on you, but the house is so unkept there are MULTIPLE issues. Horrible attitude, will show up at rude hours to make "repairs" but its just her and her boyfriend with a roll of duct tape basically. She claims to be just the property management company, and gives out false names. She's awful, avoid her like the plague. You're able to view her multiple lawsuits on the DC Courts website by looking up Tatyana Day, Tatyana Valezquez, and Exclusive Properties. She has cases under all of these. STAY AWAY!

This woman invested what I now know to be embezzled money...most likely from these very same schemes...into my small business and is not trying to sue me for it.
